1. Introduction.
These General Conditions of Sale refer to the purchase service of a culinary experience (collective/private) at the Vecchia Varenna restaurant carried out remotely via the computer network on the website https://www.vecchiavarenna.it/, belonging to to the company CASMA S.N.C. DI CASTIGLIONI LUCA E SAMANTHA, who can be contacted at the email address info@vecchiavarenna.it.
It is important to carefully read these General Conditions of Sale of the website ("Terms of Sale") before ordering Products through our website ("Product/s") together with our personal data Protection Policy. These Conditions of Sale govern the contractual relationship with reference to this website, as well as the purchase of the Products made through the same site. We recommend that you print a copy of these terms and conditions for future reference. If you do not wish to accept these terms, please do not use our Site.

To accept these Terms and Conditions, select the “Accept our terms and conditions” checkbox in the Order Confirmation section before submitting an order (“Order”). In case of non-acceptance of these Conditions of Sale, it will be impossible to order products through the website https://www.vecchiavarenna.it/new.php?lang=en.
These Conditions of Sale do not affect the rights of recognition under Legislative Decree no. 206/2006 (“Consumer Code”) and Legislative Decree no. 70/2003 (“Electronic Commerce Code”).
2. General information.
CASMA S.N.C. DI CASTIGLIONI LUCA E SAMANTHA (hereinafter also Casma s.n.c.) is a company registered with the Como-Lecco Chamber of Commerce, with registered office at Varenna (LC), Via Scoscesa number 14.

These General Conditions are applicable to the purchase service of a culinary experience at the Vecchia Varenna restaurant (hereinafter, the "Restaurant") provided to the user customer (hereinafter, the "Customer").
3. Service
The Service provides the possibility of purchasing a culinary experience (collective/private) in the restaurant using the online form.
The restaurant will use the data entered by the Client to provide the requested service and will keep them as provided in the Privacy Law (EU Regulation 2016/679 and Legislative Decree 196/2003). The Customer may request the deletion of personal data at any time.
3.1 Shopping experience.
To buy an experience, the customer must have the required amount and enter the personal data requested in the form as well as all the useful information for the Restaurant to provide the Customer Service. The Customer must ensure that the data entered is correct. At the end of the purchase, the customer will receive an email informing about all the data entered in the purchase form (please also check the spam box). Upon receiving the email, the Client must verify that all the data entered is correct. In case of mistakes, the Client will inform the Restaurant promptly by email communicating the changes to be made. Any mistake in the data entered by the Client (name, telephone number, email address, etc.) may lead to the non-provision of the experience voucher.
The purchase is subject to the conditions of the PayPal platform.
The sale will be considered finalized only after the acceptance of the means of payment used and the collection of the entire price. Confirmation of purchase requires receipt of the confirmation email from the Restaurant.
The Experience Voucher must be kept by the Buyer and presented to the Restaurant on the occasion of the event (in digital or paper format). The email containing the Voucher will be sent to you and will be required as proof of Purchase in case of fraud, theft, loss, non-activation, exchange, dispute and any other claim related to the Experience.
The duration of the experience will be 3 hours. If the Client does not come on time, the duration of the experience will be reduced by the corresponding delay time, with the consequent risk of modifying the experience with respect to what was described at the time of purchase.
The Restaurant will not refund the price of the Product in case the Customer does not show up for the event. The price will be refunded only in case the restaurant cannot hold the event due to adverse conditions, sudden atmospheric phenomena or serious impediments. The Customer will be informed of this condition by email. The amount will be fully refunded.
4. Sale and purchase of products.
4.1. Your state.
By placing an order through our Site, you warrant that:
- Is legally capable of entering into binding contracts

4.2. How the Contract between You and Us is formulated.
After placing an order, at the end of the payment procedure, you will receive an email confirming receipt of the order.
The Contract between us ("Contract") will only be formed when we send you the Purchase Confirmation.
The Contract will only refer to those Products whose delivery has been confirmed by means of the confirmation email.
The experience bonus can only be used on the date for which it was purchased.
4.3. Payment conditions.
Payment of the order must be made through the Paypal platform with your account on that platform or with your own credit card.
4.4. Consumer rights.
The following conditions apply in accordance with the Consumer Code, Legislative Decree No. 206/2005.
It will not be possible to request the cancellation of the purchased experience and the Client will not have the right to any refund.
When dealing with the purchase of an activity scheduled for a specific date, the Client will not have the right of withdrawal (art. 59 letter n): "The right of withdrawal referred to in articles 52 to 58 for distance contracts and negotiated contracts outside commercial premises are excluded in relation to: [......] n) the provision of accommodation for non-residential purposes, the transport of goods, vehicle rental services, restaurant services or related services with leisure activities if the contract provides the service for a specific date or period of execution [...]").
5. Prices and Payments
The price of each Product will correspond to what is actually reported on our Site, with the exception of cases of obvious mistakes.
Prices include VAT.
Prices are subject to change at any time, but changes will not apply to orders for which a Shipping Confirmation has already been sent.
Payment for all Products must be made via PayPal.
6. Our refund policy
It will not be possible to cancel the purchase of the experience and the Client will not be entitled to a refund of the purchase of the culinary experience in case of not being able to attend.
Although it is not possible to refund the price, it is possible to transfer the experience voucher if the Restaurant is informed of the name of the person to whom it will be transferred and the corresponding voucher is delivered on the day of the experience.
The price will be refunded only in the event that the restaurant cannot carry out the event due to adverse conditions, sudden weather phenomena or serious impediments. If this situation occurs, the Customer will be informed by email and the amount will be fully refunded.
7. Liability.
The responsibilities that concern the Product purchased are strictly limited to the purchase price of the Product.
We cannot be held responsible if we fail to meet our obligations if this is the result of circumstances beyond our control.
We are not responsible for actions taken in response to violations of our terms of use.
The foregoing limitations do not apply to any liability. that cannot be legally excluded or limited, including liability for death or personal injury resulting from our negligence.
8. Place of sale, jurisdiction and applicable regulations.
The place of sale for all transactions made on this site is Italy.
These terms are governed by Italian law, and all Contracts entered into with us for the purchase of Products shall be subject to Italian law.
The judge of the place of residence or domicile of the consumer, if it is located in the territory of the State, is competent for the resolution of any dispute with consumers that derives from these Conditions of sale or use of the Site or is related to them. In any other case, including the fact that the user is not a consumer in accordance with the applicable legal provisions, the competence for the definition of any controversy will be delegated exclusively to the Forum of Lecco.
In the event that any of the clauses of these Conditions of Sale were considered null or ineffective, the same procedure will be followed. It will be deemed non-existent and the remainder of these Terms of Sale will remain being in force, valid and sufficient.
The delay or breach by Casma s.n.c. of any power, right or resource in accordance with these Terms of Sale does not imply a waiver of them, nor does the sole or partial exercise of any of the powers, rights or resources prevent the future or different exercise thereof.
9. Processing of Personal Data
Pursuant to EU Regulation no. 2016/679 and Legislative Decree 196/2003, modified by Legislative Decree 101/2018, we inform you that the personal and tax data acquired based on established commercial relationships will be treated in accordance with current legislation on the protection of personal data in such a way that the security and confidentiality of these is always guaranteed.
The processing of this data is carried out solely by virtue of a legal basis provided for by the legislation regarding the execution of contracts or assignments with Casma s.n.c. and for the sole purpose in relation to this. All rights provided for in EU Regulation 2016/679 (articles 7, 15-22) will be guaranteed, which may be exercised by contacting the Data Controller, CASMA S.N.C.
